Privacy Policy
Last updated: 10 September 2026
We collect the minimum needed to run the game, keep it fair, and process cosmetic purchases. We do not sell your personal information and we do not use third-party advertising trackers.
1.Who we are
This policy explains how Open Seat ("we", "us", "our") handles personal information when you use the Open Seat website and game (the "Service"). Open Seat is a service of AVAMM Group Pty Ltd (ABN 39 647 157 131), a company registered in New South Wales, Australia. We handle personal information in line with the Australian Privacy Principles.
2.Information we collect
| Category | Examples |
|---|---|
| Account | Email address, a handle and display name you choose, hashed password or third-party sign-in identifier, age-gate confirmation, account creation date. |
| Profile and cosmetics | Avatar configuration, equipped cosmetic items, inventory, and your custom avatar if you buy one. |
| Gameplay | Virtual chip balance and ledger, hand histories, ratings, leaderboard position, tables joined, and anti-cheat signals. |
| Purchases | Records of cosmetic purchases, order IDs, amounts, and status. Payments are processed by Stripe — we do not receive or store your full card number. Stripe provides us limited details such as card brand, last four digits, and country for receipts and fraud prevention. |
| Communications | Emails you send us and our replies; text chat messages sent at a table (retained for a limited period for safety and moderation). |
| Technical and log data | IP address, browser and device type, approximate location derived from IP, timestamps, error logs, and cookies or local storage needed to keep you signed in and remember settings. |
In-game voice chat is peer to peer and is not recorded or stored by us. Connection setup passes through our servers using a temporary, table-specific identifier that is not linked to your public profile.
3.How we use your information
- Create and manage your account and authenticate you.
- Run the game: seat you at tables, deal hands on our servers, track chips, ratings, and leaderboards.
- Detect and prevent cheating, collusion, automation, fraud, and abuse.
- Process cosmetic purchases and provide receipts and support.
- Respond to your enquiries and moderation reports.
- Maintain security, diagnose problems, and improve the Service.
- Comply with legal obligations and enforce our Terms of Service.
Where the law requires a legal basis, we rely on performance of our contract with you (running the game and processing purchases), our legitimate interests (security, anti-cheat, product improvement), your consent (optional cookies, if any), and compliance with legal obligations.
4.Who we share it with
We share personal information only with service providers that help us run the Service, and only as needed:
- Supabase — authentication and database hosting.
- Stripe — payment processing and fraud prevention for cosmetic purchases.
- Cloudflare — website hosting/CDN, security, and real-time connection (TURN) services.
- Our application server host and email provider.
We may also disclose information if required by law or valid legal process, to protect the rights, safety, or property of Open Seat or others, or in connection with a merger, acquisition, or sale of assets (with notice to you). We do not sell your personal information, and we do not share it with advertising networks or data brokers.
5.Cookies and local storage
We use only strictly necessary cookies and browser storage — to keep you signed in, protect against fraud, and remember settings such as reduced-motion or your last table. We do not use advertising or cross-site tracking cookies. Blocking necessary cookies may stop you from signing in.
6.How long we keep it
We keep account and gameplay data while your account is active. If you delete your account, we delete or anonymise personal information within a reasonable period, except where we must keep certain records — for example, transaction records for tax and accounting, or limited logs for fraud prevention and legal compliance. Text chat logs are kept for a limited moderation window and then deleted.
7.Security
We use technical and organisational measures to protect personal information, including encryption in transit, hashed passwords, access controls, and a server-authoritative game design so your browser never holds other players' private cards. No system is perfectly secure; if a data breach occurs that is likely to cause serious harm, we will notify you and the relevant regulator as required by law.
8.Your rights
You can ask us to access, correct, or delete your personal information, or to export your account data. You can also object to or ask us to restrict certain processing. To make a request, email hello@openseat.com.au. We will verify your identity and respond within the time required by law. If you are unhappy with our response, you can complain to the Office of the Australian Information Commissioner (oaic.gov.au) or your local data protection authority.
9.Children
The Service is for adults aged 18 and over. We do not knowingly collect personal information from anyone under 18. If we learn that we have, we will delete it and close the account.
10.International transfers
Our service providers may process data in countries outside your own, including the United States and the European Union. Where we transfer personal information across borders, we take reasonable steps to ensure it is handled consistently with this policy and applicable law.
11.Changes to this policy
We may update this policy from time to time. We will change the date above and, for material changes, give notice through the Service or by email.
